PRIVACY POLICY

1. WHO WE ARE

Boared to Death Records and Boared to Death Studios are trade names of Boared to Death Productions LLC, a North Carolina limited liability company. This policy covers boaredtodeathrecords.com, including the online store and any booking or contact form on the site. It also covers boaredtodeathstudios.com, which points to the same site.

It explains what we collect, why, who sees it, and what you can ask us to do about it. We have tried to write it in plain language rather than the usual fog.

2. WHAT WE COLLECT

Things you give us

- Store orders. Your name, email address, shipping and billing address, phone number if you provide one, and what you ordered.

- Customer accounts. If you create an account, your name, email address and order history. You do not need an account to buy anything.

- Contact form. Your name, email address and whatever you write to us.

- Studio booking enquiries. Your name, band or project name, email address, phone number if you give one, what you need, your timeline, and your budget range. We ask for the budget range so we can quote accurately rather than waste your time.

- Mailing list. If you subscribe, your email address and name. You can unsubscribe from any email we send.

Things collected automatically

When you visit the site, our hosting and analytics tools record standard technical information: your IP address, browser and device type, the pages you visit, how long you stay, and the site you arrived from. This is used in aggregate to understand what people look at. It is not used to identify you personally.

Things we get from other people

Our payment processor confirms whether a payment succeeded and gives us the last four digits of the card and the billing postcode. Social platforms give us aggregate statistics about posts. Neither gives us anything you have not already shared with them.

3. HOW WE USE IT

- To take, pack and ship your order, and to deal with returns or problems.

- To answer your message or quote your session.

- To run and improve the site.

- To send you emails you asked for, and only those.

- To meet our tax, accounting and legal obligations.

We do not use your information to build a profile of you, and we do not make automated decisions about you.

4. PAYMENTS

We never see your card number. Card payments on this site are handled entirely by GoDaddy's payment processing and its partners. Your full card number never reaches us and is never stored on our systems. We see that a payment cleared, the last four digits, and the billing postcode. That is all.

If you pay a studio invoice by bank transfer, Zelle or Venmo, that transaction happens inside your bank or that app under their own terms and privacy policies, not ours.

5. COOKIES AND ANALYTICS

Cookies are small files a site puts on your device. Ours do three jobs.

Essential cookies keep you signed in, remember your cart and process checkout. These cannot be turned off, because the store will not work without them.

Analytics cookies count visits and tell us which pages get read. You can turn these off by declining on the cookie banner, or by blocking cookies in your browser.

Embedded content cookies are set by YouTube, Spotify and Instagram when their players load. You can turn these off by blocking third-party cookies in your browser.

We use Google Analytics to understand site traffic. It records visits in aggregate. You can opt out across every site using Google's browser add-on.

The banner you saw on arrival is how you accept or decline the non-essential ones. Declining does not break anything except our ability to count you.

6. EMBEDDED PLAYERS AND LINKS

Pages on this site embed players from YouTube, Spotify and Instagram, and link to Facebook and TikTok. When one of those players loads, that company can set its own cookies and see that you visited the page, whether or not you press play. We do not control that and we do not receive it.

Their privacy policies govern what they do with it. If that concerns you, block third-party cookies before browsing.

7. STUDIO CLIENTS

If you book studio time, a few extra things apply.

Your recordings

Session files and masters are yours. We hold them so we can do the work and so you can come back for them. We keep them for at least 90 days after final delivery and may delete them after that, which is why your services agreement tells you to keep your own backup. We do not license, sell or share your recordings with anyone.

Photographs, video and audio from sessions

We would like to post about the work. Your services agreement contains a media release covering photographs, video and short audio excerpts from your session, and it has a box you can tick to opt out. Ticking it means nothing from your session gets posted. Nothing is published before your release date without asking you first.

If you have already signed and change your mind, email us and we will take it down. We will not argue about it.

Your enquiry

Booking enquiries, including the budget range you selected, are kept so we can quote and schedule. If you do not book, we delete the enquiry within twelve months.

8. WHO WE SHARE IT WITH

We share the minimum needed, with companies that do a specific job for us.

- GoDaddy. Hosts the site and the store, processes card payments, sends order email.

- Google Analytics. Aggregate site statistics.

- Shipping carriers. Your name and address, so the parcel arrives.

- Our accountant. Transaction records, to file our taxes.

- YouTube, Spotify and Instagram. Only through their embedded players, as described above.

We will also disclose information if the law genuinely requires it, or to protect our rights or someone's safety. If Boared to Death Productions LLC is ever sold or merged, customer records may transfer with it, and you would be told before that happened.

9. WHAT WE DO NOT DO

We do not sell your personal information. Not to data brokers, not to advertisers, not to anyone. We have never done it and we have no plans to. We also do not share it for cross-context behavioural advertising, which is the technical phrase for being followed around the internet by adverts.

10. HOW LONG WE KEEP THINGS

- Order records. Seven years, because tax rules require it.

- Customer account. Until you ask us to close it.

- Contact form messages. Two years.

- Studio booking enquiries that did not become bookings. Twelve months.

- Session files and masters. At least 90 days after delivery.

- Mailing list. Until you unsubscribe.

- Analytics. Aggregated, on Google's retention schedule.

11. YOUR RIGHTS

Wherever you live, you can ask us to:

- Tell you what we hold about you.

- Correct anything that is wrong.

- Delete it, unless we have to keep it for tax or legal reasons.

- Stop emailing you.

- Send you a copy in a portable format.

Email us and we will deal with it within thirty days. We will not charge you and we will not make it difficult. We may need to check you are who you say you are before handing over personal data.

California residents

California law gives residents specific rights to know, delete, correct and opt out of sale or sharing. We do not sell or share personal information as those terms are defined, so there is nothing to opt out of, but the other rights are yours and the process above is how you use them. We will not treat you differently for asking.

EU and UK visitors

If you are in the EU or UK, we process your information either because we need it to fulfil a contract with you, such as shipping an order, or because we have a legitimate interest in running a small business, or because you consented, as with the mailing list and analytics cookies. You may withdraw consent at any time and you may complain to your data protection authority.

12. CHILDREN

This site is not aimed at children and we do not knowingly collect information from anyone under 13. If you believe a child has given us personal information, email us and we will delete it. Anyone under 18 should have a parent or guardian handle an order or a booking.

13. VISITORS OUTSIDE THE UNITED STATES

We operate from North Carolina and store information in the United States. If you visit or order from elsewhere, your information is transferred here, where privacy law may differ from your own. Using the site means you accept that transfer.

14. SECURITY

The site runs over HTTPS, payments are handled by a processor built for it, and access to customer records is limited to the owner and, where needed, the accountant. No system is perfectly secure and anyone who tells you otherwise is selling something. If we ever have a breach affecting your information, we will tell you and the relevant authorities as the law requires.

15. CHANGES

We will update this policy when what we do changes. The effective date at the top tells you which version you are reading. If a change is significant, we will say so on the site. Continuing to use the site after a change means you accept it.
